ParkSmarty Terms of Use

1. About these terms

These terms apply to the ParkSmarty app (the "App"), provided by StockSmarty Limited, registered in England and Wales (company number 17088000) ("we", "us"). By downloading or using the App you agree to them. If you don't agree, please don't use the App.

If you downloaded the App from Apple's App Store, Apple's Standard Licensed Application End User Licence Agreement also applies. Where it conflicts with these terms, Apple's agreement wins for anything between you and Apple.

2. What ParkSmarty is

ParkSmarty is a planning aid. It shows wait times that parks publish, crowd forecasts we calculate, weather forecasts and suggested ride orders. It is for personal, non-commercial use.

3. No guarantee of accuracy

Wait times come from third parties and can be out of date, rounded or wrong. Crowd levels and plans are estimates, accurate to roughly ±30% at best. Rides close, opening hours change, events happen and weather forecasts miss.

The App is provided "as is" and "as available". We don't promise it will be accurate, complete, uninterrupted or error-free. Always check the park's own app, website or signage before relying on anything in ParkSmarty, especially opening dates and hours before you travel.

4. Use at your own risk

You decide how to spend your day and how to use what the App shows you. Follow park rules, staff instructions, ride restrictions and safety guidance at all times. Don't use the App while driving or in a way that puts you or others at risk.

5. Limitation of liability

To the fullest extent the law allows, we are not liable for any loss or damage arising from your use of, or reliance on, the App. This includes missed rides, time spent queueing, wasted journeys, tickets, travel, hotel or other costs, or any decision you make using the App.

Because the App is free, if we are found liable to you for anything, our total liability is limited to £50.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law of England and Wales. Nothing affects your statutory rights as a consumer.

6. Free during launch

Every feature of ParkSmarty is free during our launch period. We may introduce paid features or subscriptions in the future. If we do, we will tell you in the App first, and you will never be charged without choosing to pay through the App Store or Google Play.

7. Fair use

Please don't misuse the App: no copying or scraping its data, reverse engineering, overloading our servers, or using it to build a competing service. We may limit or suspend access if the App is misused.

8. Not affiliated with any park

ParkSmarty is independent and is not affiliated with, endorsed by or connected to Disney, Universal, Merlin Entertainments, SeaWorld or any other park operator. Park and ride names are trademarks of their respective owners and are used only to identify them.

9. Third-party data

Wait times are provided by Queue-Times.com and weather by OpenWeather. We are not responsible for their services or content.

10. Changes and availability

We may update the App, change or remove features, or stop providing it at any time. We may also update these terms; the "Last updated" date shows when. If you keep using the App after a change, the new terms apply.

11. Your data

How we handle your data is explained in our privacy policy, available in the App and at stock-smarty.com/parksmarty/privacy.

12. Law

These terms are governed by the law of England and Wales. If you live elsewhere in the UK or in the EU, you also keep any protections your local law gives you, and you may bring a claim in your local courts.
