1. About StockSmarty

StockSmarty ("the Service", "we", "us", "our") is a web-based tool that provides information about exchange-traded funds (ETFs), dividend stocks, and portfolio analysis. The Service is operated by StockSmarty Limited ("the Operator"), registered in England and Wales (company number 17088000).

2. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

3. NOT Financial Advice

THE SERVICE DOES NOT PROVIDE FINANCIAL ADVICE. Nothing in the Service constitutes a personal recommendation, financial advice, investment advice, tax advice, or any form of regulated financial guidance.

All information, data, scores, rankings, portfolio suggestions, rebalancing recommendations, and dividend analysis provided by the Service are for general informational and educational purposes only. They should not be relied upon as the basis for any investment decision.

You should always consult a qualified, FCA-regulated financial adviser before making any investment decisions. Past performance of any security, sector, or market does not guarantee future results.

4. No Liability for Financial Loss

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSS, INVESTMENT LOSS, LOSS OF PROFIT, LOSS OF REVENUE, LOSS OF OPPORTUNITY, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

This includes, without limitation, losses arising from: acting on information provided by the Service; buying, selling, or holding any securities; portfolio allocation decisions; dividend projections that prove inaccurate; or any errors, omissions, or delays in the data displayed.

You acknowledge that all investment carries risk, including the potential loss of your entire investment, and that you are solely responsible for your own financial decisions.

5. Data Sources, Accuracy & Freshness

THE FINANCIAL DATA DISPLAYED BY THE SERVICE IS SOURCED FROM THIRD-PARTY PROVIDERS AND IS NOT GUARANTEED TO BE REAL-TIME, ACCURATE, OR COMPLETE. YOU MUST NOT RELY ON THIS DATA AS THE SOLE BASIS FOR ANY INVESTMENT DECISION.

Specifically, you should be aware that:

  • Dividend yields are based on forward-looking estimates sourced from third-party fundamental data feeds. These figures typically update when companies announce dividend changes and may not reflect the most recent declaration. Actual yields may differ materially from those displayed.
  • ETF holdings data reflects the composition reported by third-party providers and may be delayed by days or weeks relative to the fund's actual current holdings.
  • Company fundamentals (including sector classifications, share prices, and financial ratios) are generally updated on a quarterly basis following earnings reports. Between updates, data may be stale or may not reflect material changes in a company's circumstances.
  • Scoring and allocation calculations are derived from the above data inputs and are therefore subject to the same freshness limitations. A score or allocation percentage should be treated as an indicative starting point, not as a precise or real-time measure.
  • Stock prices shown are end-of-day prices, typically updated 15 minutes to 3 hours after the relevant market closes. They are not real-time and should not be used for trading decisions.

We make commercially reasonable efforts to keep data current but provide no warranty as to the timeliness, accuracy, or completeness of any data displayed. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

We do not warrant that: the Service will be uninterrupted, error-free, or secure; the data, scores, or analysis will be accurate, complete, or current; any defects will be corrected; or that the Service will meet your specific requirements.

6. No Service Level Agreement

We do not guarantee any specific level of uptime, availability, or performance. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We shall not be liable for any downtime or service interruption.

7. Subscriptions & Payments

The Service offers free and paid subscription tiers. Paid subscriptions are billed monthly via Stripe, our third-party payment processor. By subscribing, you also agree to Stripe's Terms of Service.

Subscriptions automatically renew each month unless cancelled. You may cancel at any time through the Manage Subscription portal; cancellations take effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for.

Plan upgrades take effect immediately with prorated charges. Plan downgrades take effect at the end of your current billing period.

8. Refund Policy

All subscription payments are non-refundable. Because you can cancel at any time and retain access for the remainder of your billing period, no refunds will be issued for partial months, unused features, or dissatisfaction with the Service.

9. Intellectual Property

All intellectual property rights in the Service — including but not limited to the software, design, algorithms, scoring methodologies, branding, logos, and content — are owned by or licensed to the Operator and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes only. You may not: copy, modify, distribute, sell, or lease any part of the Service; reverse-engineer or attempt to extract the source code; use automated tools to scrape, mine, or extract data; or sublicense access to the Service.

Portfolio data, stock selections, and other content you create within the Service remains your property. However, we retain the right to use anonymised, aggregated data for the purpose of improving the Service.

10. Your Account & Obligations

You must be at least 18 years of age to use the Service. By creating an account, you confirm that you are 18 or older.

You are responsible for: maintaining the confidentiality of your login credentials; all activity that occurs under your account; providing accurate and truthful registration information; and complying with all applicable laws.

You must not: create multiple accounts; share your account with others; use the Service for any unlawful purpose; attempt to gain unauthorised access to the Service or its systems; or interfere with the proper functioning of the Service.

11. Data Protection

Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms. Login credentials are managed by Supabase (our authentication provider). Payment information is processed and stored exclusively by Stripe — we never see or store your card details.

12. Third-Party Services & Data Providers

The Service relies on third-party providers including Stripe (payments), Supabase (database and authentication), and Vercel (hosting). We are not responsible for the availability, accuracy, or security of these third-party services beyond our reasonable control. Each provider operates under their own terms and privacy policies.

Financial market data — including ETF holdings, dividend yields, company fundamentals, sector classifications, and stock prices — is sourced from third-party financial data providers. This data is provided to us under licence and is subject to the following conditions:

  • The data provider does not guarantee that its data is real-time or free from errors. Data may be delayed, incomplete, or inaccurate.
  • We cache and store data locally to improve performance and reduce latency. Cached data may be up to 24 hours old for holdings and dividend information, and longer for less frequently changing fields such as sector classifications.
  • We do not independently verify data received from third-party providers. Any errors, omissions, or inaccuracies in the underlying data will be reflected in the Service's analysis and outputs.
  • If a third-party data provider experiences downtime, discontinues its service, or changes its data coverage, the Service may be temporarily unavailable or may display incomplete results. We shall not be liable for any such interruption.

The data displayed by the Service is for informational purposes only. It is not sourced directly from any stock exchange and should not be treated as official exchange data.

13. Suspension & Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to: breach of these Terms; suspected fraudulent activity; abuse of the Service; or non-payment.

You may delete your account at any time through the Account Settings page, provided you have first cancelled any active subscription.

14. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability to you for any and all claims arising from or related to the Service shall not exceed the amount you have paid to us in subscription fees during the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under English law.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice within the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Data Retention on Account Deletion

When you delete your account, we immediately and permanently delete your portfolios, usage records, and authentication credentials. We also remove your display name and cancel any active subscription.

However, we retain a limited set of data for up to six (6) years following deletion, as permitted under UK GDPR Article 6(1)(f) (legitimate interest) and Article 17(3)(e) (establishment, exercise, or defence of legal claims). The retained data includes:

Your email address — retained as proof that you accepted these Terms and used the Service, in case of legal claims or disputes. This is particularly important for users who did not make payments, as no Stripe record exists to identify them.

Your Stripe customer ID (if applicable) — retained to cross-reference with Stripe's financial records for HMRC tax compliance (6-year retention requirement).

The date you accepted these Terms — retained as proof of contract formation.

Your subscription tier at time of deletion — retained for aggregate business analytics (churn analysis). This is non-personal data.

Your marketing consent preference — retained as a record of consent given or withheld under UK GDPR.

After the six-year retention period expires, any remaining personal data (specifically your email address) will be fully anonymised or deleted. You may contact us at any time to request information about what data is retained following deletion.

18. Survival

The following sections shall survive termination or deletion of your account and continue to apply: Section 3 (Not Financial Advice), Section 4 (Investment Disclaimer), Section 5 (Data Accuracy), Section 8 (Refund Policy), Section 9 (Intellectual Property), Section 14 (Limitation of Liability), Section 16 (Governing Law & Jurisdiction), Section 17 (Data Retention on Account Deletion), and this Section 18 (Survival).

20. AI-Generated Analysis

Certain paid subscription tiers include access to an AI-powered portfolio analysis feature ("AI Analysis"). This feature uses a third-party large language model (Anthropic's Claude) to generate commentary about the stocks in your portfolio.

The AI Analysis feature is provided strictly for educational and informational purposes only. It does not constitute financial advice, investment advice, investment research, or a personal recommendation of any kind. It is not tailored to your individual financial circumstances, investment objectives, risk tolerance, or tax situation.

AI-generated analysis has significant limitations:

  • It is generated automatically and has not been reviewed by any human financial analyst or regulated professional.
  • It may contain errors or inaccuracies. AI models can produce plausible-sounding but incorrect statements.
  • It is based only on the data supplied at the time of the request and does not account for real-time market events.
  • It does not account for your personal financial situation, tax position, or investment objectives.

We accept no liability whatsoever for any loss, damage, or adverse outcome — financial or otherwise — arising directly or indirectly from your use of, or reliance on, the AI Analysis feature.

By using the AI Analysis feature you agree that:

  • You will not rely on AI Analysis output as the basis for any investment decision.
  • You will conduct your own independent research and consult a qualified financial adviser where appropriate.
  • The feature is experimental and may not always produce accurate or complete output.
  • We may modify, restrict, or withdraw the AI Analysis feature at any time without notice.

The AI Analysis feature is powered by Anthropic's Claude. Your portfolio data (stock tickers, allocations, dividend yields) is transmitted to Anthropic's API for processing. No personal identifying information is included. Anthropic's own privacy policy applies to their processing of this data.
